TAFE, one of India's largest tractor manufacturers, has asserted its legal ownership of the Massey Ferguson brand in India. The company has now filed a contempt petition against AGCO Corporation, an American firm, accusing it of violating a court order regarding the use of the Massey Ferguson name in the country.

TAFE's statement comes after the Chennai Commercial Court issued an interim order in April 2024, directing both companies to maintain the current status of brand usage. TAFE alleges that AGCO’s recent actions challenge this ruling, leading the Indian firm to take legal action to protect its rights.

TAFE’s Long Partnership with Massey Ferguson

TAFE, which was founded in 1960, has been manufacturing Massey Ferguson tractors in India for decades. The company produces over 100,000 tractors each year and has 3 million customers across the country. TAFE has invested in research and development to create more than 500 tractor models suited to Indian farmer’s needs.

Although AGCO owns the Massey Ferguson brand globally, it has remained silent on its association with India, Nepal, and Bhutan for over 60 years. During this time, TAFE exclusively managed the brand in this region. Today, TAFE is the second-largest tractor producer in India and the third-largest in the world, known for its reliability and customer satisfaction.

TAFE has been a major shareholder in AGCO since 2012, strengthening the partnership. However, recent conflicts over the brand’s usage led TAFE to take legal steps against AGCO.

Legal Dispute and Court Actions

The legal dispute arose when AGCO allegedly tried to challenge TAFE’s rights over Massey Ferguson in India. In April 2024, the Chennai Commercial Court ordered that neither party could make changes to the status quo of the brand’s use.

Despite this, TAFE has now filed a contempt of court petition, accusing AGCO of not following the order. TAFE argues that AGCO's actions could harm its ability to introduce necessary reforms in AGCO's management and performance. The Indian company, which had avoided public disputes, felt it had no choice but to defend its interests in court.
